Beat pacing speeding ticket?

How and can I beat a pacing speeding ticket in the State of Washington. An unmarked police car pulled me over for a pacing speeding ticket. 75+ mph in a 60mph zone. Sun, Nov 15, 09 I was driving EB coming out of the I-90 tunnel over the Lake Washington bridge. It was a 3 lane freeway and was in the middle lane changed lanes into the right and changed back into the middle lane. His lights came on a little after we came out of the tunnel. It was rainy and gloomy out with less than moderate traffic. There was more than a handful of cars around or behind me. When his lights came on it was after I had did my last change to the middle lane with no one in front of me and maybe 1 car on the left of me about the same pace. Is it possible to beat it without a lawyer? If so how?Beat pacing speeding ticket?
OK, You're upset about the ticket but let's look at some possible defenses you could mount to beat or at least lesson the damage. If you admitted you were speeding then there is no reason to continue. If not these ideas may or may not be of any help to you.

There are several things we don't know about the situation. My first question is what time of day a lighting conditions did this occur in? I'm guessing less than optimal since it was raining and you were in a tunnel part of the time.

Honestly a pacing ticket is going to be pretty hard to beat, you could always argue that during the lane changes that you made that the officer was actually pacing another car and pulled you over by mistake. If the lighting was bad and the traffic was fairly heavy this could be what happened. In low light situations it's possible that the officer spotted a similar car to yours and pulled you over when you made a lane change. It's a long shot and not likely what happened but I'll throw it out there anyway.

The other idea is the plea down. I'm sure WA has some sort of catch all traffic violation you could plead to, around here, it's ';improper equipment';. You could argue that you actually identified the officer's unmarked car well before he began pacing you. But based on his speed and the speed of the traffic around you felt you were traveling at or near the posted speed limit. (After all shouldn'tthe officer be setting an example in traffic) Since you weren't then your speedometer must be wrong, due to improper tire sizing, or whatever. You will plead guilty to the charge of improper equipment, or whatever non moving violation you can find instead of speeding. This way the court gets their money, but you don't get any points which will drive your insurance costs up, so you're only out the fine money. Of the two ideas, this one is the most likely to work.

You can always hire a lawyer, sometimes they can be of some help. They will cost you, but if you can avoid the points it still may be worthwhile. You would have to make that call based on your driving record etc.

It`s virtually impossible to beat a ';pacing'; ticket . If the cop was driving behind you while you were speeding , how are you going to convince the judge you weren`t speeding , especially without calling the cop a liar ?? It`s your word against the cop`s , and it`s obvious who`s word the judge is going to accept . Also , as soon as you imply the cop is liar ......... your case is lost !



As to when the cop turned on his lights , it`s meaningless to your case . When he turned on the lights , it meant he already had his evidence . He could have gotten it at any time throughout the ';pacing'; .............



I can`t see that retaining a lawyer would do you any good .
Not once did you say you weren't speeding.

Are you trying to say that everyone was speeding, and that would make it ok for you to do the same?



Pacing is a valid way of determining speed.



You have given zero details that would lead any sane person to think that you could get out of this ticket. Grow up and take responsibility for your actions.

I would simply plead innocent. Safe speed. So safe the police feel comfortable driving it too.



Pacing means in the same conditions they followed happily along. If they issue you a ticket, the police need one too.

1. No big deal, move over and let him pass, then drop right in behind him. I figure I might be able to make a little better time using a trucker as a lead.



2. Major league ******. I would have moved over if I was in the left lane, but if he's in the right lane behind me doing that, all that will accomplish is dropping my speed 10-20 mph, after a hard brake check. He can go around, and preferably crash into a streetlight down the road.



3. I don't really care, I'll go back down the aisle and around. Don't have the time or inclination to let that get to me.

So I live in WA

and I was driving from the store to home at like 8pm and it was really dark but I did have my glasses on



and I was turning left and there was 2 left turn lanes and I was in the far left lane and when i started turning there was no one behind me or in the lane next to me and I turned left to the far left lane and I had to hurry and get over one lane to the right to make it to the gas station so I looked in the rear view mirror and started going and then all of a sudden there was a car black car there and I tapped it. I dont understand where it came from! I looked back and it was clear and when I first started the turn there was no one next to me

He had to have been speeding to make the light because when i 'hit' him he was further ahead of me



So anyways after it happened I didnt know what to do and I like casually drove off and he followed me like forever and I was too scared to pull over. He was following me and then he started to slow down so then I hurried and made it home without him seeing where I lived (we were right around the corner to my house)

and I parked in not my right parking spot

so like a hour later I went outside to move it and all of sudden the police were there and they were starting to tow my car so my mom went out there and was like my daughter was driving this car....



and they gave me ticket for $124 for ';unsafe lane change, not changing lane with 100 yards clear in front and back'';

and then another ticket thing for hit and run that doesnt have a cost

and I have to go to traffic court next month



Im almost 17 and have never had any traffic or law violations before

also my car doesnt even have a scratch just a small little dent and his car was a big like black SUV or something and im pretty sure it has like no damage and it was just a little tap

The traffic court and cost will be the least of your problem. Last year there was an famous actress who ended up in jail because she didn't stop after an accident. Go see a lawyer. Any more advice from here, and you are screwing yourself.

OK read this first. go to traffic court and plead not guilty.then wait for the other diver to sue. if he doesn't you are home free, that means he does not want to go to court and can not be a witness in the traffic hearing as the police did not ';witness'; the moving violation they can not testify as to the facts. they will not show up to the hearing and if they do they will not have a answer to the question ';did I hit anything that night?';Do not speak of this or elaborate on it to anyone it did not happen as far as you know.

Im guessin he's gonna try to nickel and dime you if there's damage on his car being that ';you' hit him even if you didn't. Your a kid and kids make mistakes more than adults. Your unexperienced and people will try to use that as there alibi. Im 19 and Ive seen a lot of stuff within the 2 years Ive been driving.



Plead not guilty and accept the damage. Pay it off and in time you'll get back what you lost.

    Go to court. Carefully and respectfully articulate to the judge your fear of pulling over in what you ';perceived'; to be an unsafe area. Explain that you could not locate a populated enough area to calm your fears and it was your intent to call the police to explain what had happened once you were safe at home and you had explained it to your parents. Explain you know what you did was wrong and due to inexperience as a young driver. Don't defend your driving. Take the ticket for the unsafe lane change but argue the hit and run / leaving the scene of an accident based on intent. If you stick to this argument only, the judge may dismiss the hit and run and stick you with just the lane change.



    Good luck, and next time, keep your cell phone close. Call police as soon as there is contact. If you don't feel it's safe to pull over where you are, put on your flashers and procede to the safest, populated, well lit area while telling the police what you're doing. Hind site is 20-20 they say. Maybe the judge will understand.

    And you are right, the most caring, respectful, honest and tolerant people I have ever met are my biker sisters and brothers.

    I'm sorry to say, but I hate bikes. Scare the bloody hell out of me. Far too fast for what they are and then people wonder why there are accidents. The fastest speed limit in this country (England) is 70 so why do you need a bike that does 170??? Plus, in the City most of them drive like d*ckheads anyway and do what the hell they please - most of them think the rules don't apply to them, mainly couriers on mopeds!! Don't get me wrong, there are just as many d*ckheads driving cars. The problem is people are in too much of a hurry these days





    I'm not trying to have a pop at bikers here. There are people on the roads who don't give a damn and are careless - people on bikes and people on cars, even people on foot who aren't driving. Any biker I've met has been nice to me and I've not had a problem with. It's those bloody ar*eholes that I don't meet that speed past me bibbing going through a red light that I can't stand!!
    That very thing happened to one of my friends who was a biker. I lived on the streets when i was 10 and i met alot of bikers in the city, they were great, they looked after the street kids and helped them out, i got to know all of them and they were my big brother and they all took me under their wing and loved me like a sister. when i grew up i got my own place and not long after i feel pregnant and didn't;t go to see them much but when i did they all were so very happy to see me. The biker i knew I will name gypsy ( not his real name) he was so sweet and he only got to see my first child and was happy for me to ask him to be her uncle but sadly one day when we were going to meet it was a stormy day and i told him not to worry about coming and we could meet another day, but he said no and that he was coming and that was that,





    But he didn't turn up he was just around the corner when a freaking bus decided to run the red light and hit him.





    I wish all people would just show some respect to all bikers, they are not bad, they may put a tough look on but really they are just like me and you. They ride their bikes to raise money for charities like the cancer foundation and Christmas appeals. These guys do so much for people and most of the people just treat them like criminals. I see them as ANGELS in disguise.

    Car Accident! She's lying! Help!!?

    I was in an accident gave my version to my insurance and the other party involved. She refussed to give her version to my insurance. I was in a right hand turning only lane. Se was in the only other lane to go straight stopped in traffic. I was going about 30MPH and as soon as I got inches from her she decides to change lanes, we hit . I hit her right passenger door and my car is damaged on the driver side.So my question is this, she is saying I was trying to overtake her car. I am not sure what she means. I was told by both insurance companies that she was ';A weird Lady';. Her insurance Co. told me that it sounds like she was at fault but needed to take pictures and get her statment. Well now it looks as if neither Insurance Co. is budging. Mine is sticking to my story and her insurance is sticking to her story. What can I do to get my car fixed I have liability only. I need her insurance to pay for my damages. Looking at the pictures its clear to see how the impact occurCar Accident! She's lying! Help!!?

I would continue to let the insurance company handle the situation....I was involved in an accident and was in the far right lane and an elderly man was stopped for the light for the left turning lane and he decided he was going right came across 3 lanes or traffic and I hit their van going 55 and flipped it, thank God we only had minor injuries and witnesses. you ins does not want to pay the claim so they will fight the other company until the matter is resolved. good luck!!!Car Accident!     you should have called the police when it happened and reported the accident.
    Actually, you probably don't need an attorney at this point, it will cost you too much money. Just continue to call your insurance company, it's really between them. Also, try calling her insurance company. Just be persistent, it will work out.
    If you didn't get a police report (and I know sometimes they don't respond to fender benders), you may be out of luck. Call and ask if you can file a report.



    Your insurance company has no interest other than avoiding paying for liability. They don't care about damage to your car.
    join the club!! i was in an accident last friday. at the scene of the accident, the idiot totally accepted responsibility but when my insurance agent spoke to him, he said he didn't know who was at fault.

    as for your case, her insurance is supposed to fix your car. if she refuses to give her version of the accident, she must be hiding something. good luck, and if they don't fix your car, sue her and her insurance company.
    The insurace companies are pretty good at determining fault regardless of the lies told by the people involved. Was an accident report taken by the local police? Were there any other witnesses. It doesn't sound like either insurance company is buying her side of the story, so unless her insurance company is not going to pay for your losses, don't worry about it.
    Again, her insurance isn't the one paying. If the accident is her fault, and it sounds like it is, she is responsible to pay, and then it's between her and her insurance if she gets reimbursed for that money. If your insurance won't assist you going after her for damages, you may need to seek legal advice, which will cost, but when the other party is found at fault they will have to pay your court costs and reasonable attorney's fees. Good luck with it.

    Definately get an attorney, but you made a huge mistake by not calling the police, they issue a ticket to the person at fault, so the insurance companies couldn't deny it.. GOod Luck...
    It is your insurance company's JOB to figure out who is going to pay for your car. That's what you hire them for. Call and complain! That's their job.
    No you don't. Trust me, If there is a problem you need to get YOUR INSURANCE COMPANY to fix it. Trust me, if they pay for the damages they will go after the other insurance company. It is what you pay THEM for. Quit doing your insurance company's job for them.
    Why did you not go to the police? You should have filed a police report to document your side of the story. You should try and get a police report filed now, so at least you have your story legally documented. Also, if it happened on a busy street, there may have been a traffic camera that has it all on tape, so you should contact the police. This woman may have also been in other accidents, and I'm sure the police can look up if there have been other similar complaints against her. If so, you can take that as proof of a pattern of lies and deceit to the insurance company.
    Unfortunately, your pictures will only show how the cars met, not who changed lanes. If you don't have collision coverage, your insurance company can't handle this for you, they can only offer advice.



    In a case like this, it's ';story vs story'; or ';driver vs driver'; and both insurance companies are legally obligated to protect their insured's version.



    Look in the blue government pages of your phone book and file with the local District Justice or Magistrate against the other party (not her insurance company). The clerks who answer the phone can usually walk you through the process. Make sure you have pictures, at least one good estimate of repair (2-3 would be better), a scene diagram (and photos of the scene!) as to how you say it happened, and anything else that might help you.



    A judge, unlike an insurance adjuster, can decide who he or she thinks is lying. Make sure you ask for your damages, rental for repair time (get an estimate on days to repair and x $25/day or so for repair time) plus your court costs.



    If you win at the DJ/Magistrate, her carrier will honor the award.

    She's saying you tried to go around her and get into her lane and hit her. This is word vs. word. If there are no witnesses, don't expect her insurance company to pay for your damages. They will side with her as long as the evidence does not go against her. Right now, all they have is your version, her's and the damages. The damages will probably support either version- which means your claim will be denied. Your insurance will probably deny her if she makes a claim against you. With liability only, unless you file a civil action in small claims (and there's no guarantee there either) you will not get paid voluntarily by her carrier.



    If the vehicle damage weighs heavily on either side that is the person who will prevail.

    I just received a ticket for driving too closely?

    I live in MD and I haven't had a ticket in 10 years. I was driving in the left lane on interstate 95, and the vehicle in front of me was varrying its speed from 5 miles/hr over the speed limit to 5 under. There was no accident and I didn't change lanes for several miles. I hate changing lanes, as I find it unsafe. The cops have been very active (in my opinion trying to make up the 2 billion state deficit)... So anyway, the cop runs up on me at like 90 and turns his lights on. I pull over and he ask the standard question... And this time, unlike the last time (10 years ago) I had no idea why he was pulling me over. I understand he hears it all but there was no discussion or explaination... just I'm going to ticket you';... But he did say he say me in the right lane doing the same things... After he got back with the ticket I mentioned that I haven't been in the right lane for 30 miles(remember I don't like changing lanes) He huffed and stated something to the effect that he had it all on tape and he didn't care...



    My first question is what is too close... obviously if you rear end someone that is too close, but who is the judge and how do you judge from 300 feet behind and several vehicles...??



    My second is will they use the tape in court... I hope so because it would be to my benefit. If not can I get a copy?



    Lastly are there any defenses? I have heard that some of the yahoo judges find you guilty without even hearing a word....

    First question... the general rule is two seconds. You do not need to cause an accident to be cited.



    Second question... You should be able to get both the officer's notes and a copy of the tape through the department under Open Records Law.



    Third question... the answers on this site can be all over the place. Chances are, the judge found them guilty for a reason.I just received a ticket for driving too closely?
    I hear you......I just got a ticket for the same thing..... I was going 37 in a 55 zone, can you imagine how slow the car in front of me was going???     First question, According to the State of Maryland driving too close is when a vehicle is 3 -4 seconds from impact of another vehicle. That really is at the officer's discretion. (Pg 20 of the Maryland Driver's Handbook)



    Second question, it is unlikely the video tape itself will be used in court but the officer's report should be presented to the prosecutor and the judge. You can subpoena the records such as the report and the video tape.



    Third question, it really depends on the judge's character and previous cases. Most of the cases I've seen where a judge would not consider someone's innocence is when the defendant has prior infractions.



    My recommendation to you would be to hire a traffic attorney. This could affect your insuruance rates and requesting records can be time consuming. Contact attorneys in your area, some offer free consultations as to what they can do for your case and then tell you how much they would charge if you hire them. Attorneys may be able to find faults with the officer or in the procedure in which your case was handled and that would be enough reasonable doubt to dismiss a case or plead for a lesser charge that won't affect your points or your insurance.

    Usually someone is at fault in any ';accident';--sometimes both are partially at fault. Criminal charges resulting from death in an accident requires more than mere negligence (which is what your scenario describes)--it requires recklessness, a much higher standard. Drunk drivers are reckless. People driving WAY over a safe speed are reckless.Would this be a crime?

    Even if a car accident results in death, neither driver should be charged unless it can be determined that one driver was operating his car in such a way that it lead to the accident and death. Driving 65 in a 55mph. zone would not normally result in charges, but driving 110mph in a 55mph zone could be considered reckless and dangerous. Driving on the wrong side of the road, drag racing, driving under the influence of alcohol/drugs could all be considered offenses that could lead to prosecution.



    The scenario you describe doesn't seem like it would lead to criminal charges.
    I would think not because the only thing the driver was trying to do was change lanes. As long as he did it with signals and in a safe manner. At the same time, it is his responsibility to make sure he had a clear lane to go into. The only crime I would think could be reckless endangerment or illegal lane change.

The car is about to go, but a SUV from the intersection pulls in front of the car in the left lane and stops. There's a minivan in the right lane, so the car can't change lanes. So, out of road rage, the car uses the center turn lane to pass illegally and the SUV attempts to make a U turn and they collide.



    When the police arrive and ask questions, the driver of the car was going to say he had to swerve to avoid the SUV that cut him off, but the cop asked was he turning left at the gas station on the corner and the driver of the car said, ';yeah, that's it, I got into the turn lane to make a turn.'; If there was a place to turn and that's possible, then the SUV would be at fault for unsafe lane change or illegal/unsafe U turn? I know it may not seem fair for a driver to get away with road rage, but if there was a place to turn then how would they be able to prove that the car didn't get into the turn lane to turn instead of passing illegally.



    When insurance investigates accidents, do they ask detailed questions about why they were turning there, where they were going? Such as in this example, if the driver said he was intending to turn in the gas station and they asked what for and he said to get gas, would they be smart enough to check the gas gage in the car to see if he needed gas? And if he has a full tank, then his story wouldn't add up. Of course he could say he was going there to get a soda or something else.



    Also, if he told the police a different story such as he swerved to avoid the SUV and later told the insurance that he got in the turn lane to turn, 2 different things, would insurance not believe anything he says because his stories aren't consistent?

    Dude, I have read your question three times. I am completely lost on that first paragraph. Many areas, Uturns are illegal. Most of the time, if there's an accident involving someone making a U turn, the guy with the U turn is at fault. If (trying to read this), both these cars are pointed in the same direction, and the left most car turns left, and the car to the right makes a U turn, the u turn car is at fault.



    Insurance will compare the statement to them, with the statement on a police report. However, keep in mind, these days in most urban areas, if both cars are drivable, and no one is injured, most of the time the police won't even come to the scene.

    How can I be at fault?

    I was coming home from work and it was raining moderately. I was at the corner of Street B turning right off of Street A at the same time I was coming up to Street B another car was coming from the opposite way turning left on to the Street B, while he was waiting for me to turn right into the street another car hit him from behind the car was changing lanes to avoid waiting behind him, I see that the car was hit. I turn into Street B and turn out to Street A, while I was in the process of coming out of Street B I go to turn left at the same time I am about to turn left traffic from both sides of the road were coming so I stoped to let them pass (this is a 4 lane road) while I was stopped a little away from the stop sign on Street B a car approaching from the left lane where the previous car was hit. the driver thinks that I am in the middle of the road approaching her lane and moves to the far right lane. The car makes it to the right lane sees the cars from the previous accident parked and slows down ( She didn't slam on her breaks because there were no screeching and no skid marks) while in the process of moving to the right lane another car from behind rear ends her while this was happening I didn't even cross the street until after they hit each other.



    The driver was rear ended claims that she moved over to avoid hitting me (when I know I wasn't there and non of the drivers saw me there)



    The police officer is claiming that I was at fault for the second accident she told me I made a illegal U-turn over a solid yellow line. She issued me a ticket for ';Improper change of course'; while taking pictures after their accidents I come to find out that the road I turned into had no lines at all and I stopped at the stop sign before turning left back onto the road. which is a legal turn.



    Also I know that I wasn't in the lady's lane because cars were passing in front of me and the lady even said that cars were passing me. My car is a decent size (2008 Hyundai Elentra).



    If it were true that I was in her lane then I would have been blocking two lanes and no cars could get around me. Also the guy that hit her said that he never saw me at all until I was pulled behind his car after the accident.

    On May 2nd, around 1:30 am, I was traveling on Center Point East, going toward Ashford Dunwoody Rd to go home. When I came up to the corner of Ashford Dunwoody, I made a right hand turn. At the right hand corner I saw 2 Dunwoody police officers, who had made a traffic stop, about 25 yards away in the right hand lane. So I turned into the middle inside lane and reduced my speed to 25mph, because there were 2 other cars that were now traveling in the far left hand lane going in the same direction as I was. Both police cars had their blue lights flashing and the other 2 cars headlights made it hard to tell if it was safe to go into the third lane. Since I was not certain it was safe, I stayed in the lane I originally turned into and continued to drive at 25 mph.



    After I passed the police officers, they drove out and pulled me over. When the police stopped me, they indicated that I should have taken the third lane even though I had slowed down to 25 mph. I feel that I was in the right in making the judgment due to the obstructed view created by both the police’s lights and the headlights of the other cars. I couldn’t see due to the brightness to feel I could move over safely, and when I was questioned as to why I did not change lanes, I told the officer the above reason.

    Trouble checking blind spot while driving?

    I am a new driving (yes, a teen driver).

    I had several months of lesson and just got my license. I've driven by myself twice.



    I hope it's because of my lack of experience....





    BUT. whenever i do check over my right shoulder in order to change lanes...



    i can't differentiate how far away the car on the right is from mine?



    FOR EXAMPLE

    today, i was changing lanes to the right.



    i checked over my right shoulder. I saw the car, but thought i had a fair amount of space. but when i did change the lanes, the car started to honk at me and I apparently cut that person off.



    Also, whenever I drive, i just have trouble changing lanes because whenever i look over the shoulder... i just don't see/ can't see the car or the distance / gap there is. I don't know.

    The first step is to adjust the rear-view mirror to do exactly that - give you a view directly to the rear. Position it so that it best covers your view straight out the rear window. Don't bother tilting it to one side or the other to assist with your view of traffic to either side of your car. That's what the side mirrors are for.



    Next, lean your head until it almost touches the driver's side window. Then, adjust your left side mirrors so that you can just barely see the side of your car, and no more than that.



    Lean your head to the right towards the middle of the car and adjust the right side mirror so that you can just barely see the right side of your car. You should NOT be able to see the side of your car when your head is perfectly upright.



    Check for blind spots by doing the following: While driving along a four-lane road in the right lane, note a vehicle in the left lane coming up to pass you from behind. Without moving your head, glance in the rear-view mirror and follow it as it approaches your car in the left lane.



    Just before it disappears from your view in the rear-view mirror, glance to the left side mirror. There it is. Now follow that vehicle in the side mirror as it begins to pass you. Then, just before it disappears from the side mirror, you should see it with your peripheral vision.



    Notice that without even turning your head, you never had a blind-spot. Then try it with the right side mirror. Watch as you pass a vehicle travelling in the right lane go from your peripheral vision, to your right side mirror, to your rear-view mirror.

    If you have to check to see if they're in your blind spot, they're close to your car.



    If you can see them in your mirror, they're further back.

    And being short has nothing to do with it. Adjust the seat so you can see properly. All modern cars are designed to accommodate the normal range of human height. So unless you're a dwarf, you shouldn't have a problem.
    It is probable that when you look over your shoulder you are looking with one eye only so 3-D vision is not in effect. Why don't you use the side view mirrors for rear vision? This would seem the safer option.
    To gauge distance, use the two headlight rule: If you can see both headlights in your mirror, you should have enough room to merge. Unless they are speeding up quickly this will give you lots of room. If, when you do your shoulder check, you see a car in the next lane that you could not see in your mirrors, they are too close and you should not merge.
    If you can see the car over your shoulder , then you must not merge out.If in doubt, do nowt, as the saying goes.Why not take the Pass Plus course( if you are in UK) which will improve any areas that you find difficult.The dizziness is caused by the stress you feel.Try to relax and think about what you are doing .Plan well ahead and always know whats behind you , so that when you want to change lanes ,you know whether you can well in advance rather than take a risk at the last minute.If you plan well in advance of any change of lanes you will feel better ,and the adrenalin rush that causes your dizzyness will go away, because you will know that you are not taking dangerous risks.
    You need practice. I had the exact same problem as you, and I can now change lanes by myself. Move your mirrors so you don't have to turn your head so often, and practice looking in the mirror and seeing how far away things are. Good luck!

    I got a ticket on I580. The officer claims that I was speeding at 88 MPH in 65 zone (violation 22349). I am 100% certain I was not going faster than 72 for the following reasons:-

    1- My car is brand new (I don't have the license plates yet) . I am trying to break it in and I do not rev the car higher than 3000RPM (car is stick shift). At 3000RPM in 5th gear the speed is 72 MPH

    2- The area is known for speed traps. I check my speed consistently



    I believe here is what happened. Right before I got pulled over, another car (same color, and similar shape) was tail gating me in the most left lane. I changed lanes lane to let him go, and switched back to the left lane. The cop pulled me over in 2 minutes. My believe is that other car was the one they saw.



    The cop also indicated that he followed me and I was speeding at 83. This is also not possible since:

    1- I saw the cop switch lane behind me about 200 feet back (this happened during rush hour, and the lane next to mine was full).



    2- Seeing his lights, and not thinking it was for me, I immediately changed lanes to let him go and also checked my speed limit (about 69MPH)



    3- He followed me so I continued to change lanes until I was on the shoulder at neither of these time, I was going any faster than 65MPH.



    Details of the ticket:

    The tickets says approximate speed 88; but it does not indicate how is was determined. It does not have the Radar/Lidar Unit/Patrol Vehicle No. either. I am not sure if these help, but thought to write it.



    My last ticket was over 4 years ago for going 10 miles over the limit.

    Print this list out and give it to the judge, and explain it all to him. There are some judges that have common sense. You may be blessed with a good one. He will look at your record, and may even dismiss it. I got ticketed for speeding once when I knew for a fact that I wasn't, primarily because I had just turned on to the street and there is no way possible that a 1985 4 cylinder car could go 60 mph in 200 feet.     Either way, at several points you WERE speeding anyway. It's rare that people win in these kind of cases, unfortunate but true.
    You can't you call tell the judge and he may go easy on you but the new radar MachIenes prints out a paper and is attached to the officers copy and sent to court, keeps the police out on the street not in the court room. The officer might have made a mistake but who do you think there going to believe? bite the bullet tell him you did not think you were going that fast and think he may have made a mistake but am not sure and he will go easy on you, at that speed 88 your about 15 miles an hour over the limit which is reckless driving and he could of arrested you, he may wrote on the ticket est speed and did a guess but he will win, Don't go to court and take one of our officers off the street to fight a ticket since it is only one go to traffic school and it will stay off your record. I have been guilty too with a new car doing 80 miles an hour and think I was doing 70 it's easy to do with the ultra good suspension and quietness of the cars of today. Good luck and watch your speed I bought my 2008 with cruise on it so I can set it and be safe cause it's real easy to creep up to 80 or 90 when the rest of traffic is doing it.
    Your best bet is to contact the courts and ask them these questions. They are the ones who will process your ticket and will know all the laws and regulation. You should also ask the courts if you are allowed to take a driving school class. This will prevent your insurance from going up and points from being placed on your license. Just make sure you get the courts permission before doing so. If you don檛 the courts will reject your driving school certificate. Good luck!

    Road Rage or Rudeness?

    OK, So I am a grown woman, mom of 2, not on a cell phone, just minding my own business, driving the speed limit (or above) on the freeway. I see a space to change lanes, so I turn on my blinker and begin to get over. The guy in that lane decides to be a jerk and substansially speeds up, not allowing me to safely get over.

    Why?



    It's interesting to me how often this happens... when someone puts on their blinker in front of me, I coast a tad to let them in safely.

    It's rare I even get a thanks.....

    Maybe he was following someone and did not want to have someone come between him and the other car. Also, I know of many times when there is a long line of cars approaching an exit and there are people who do not want to be in line try to get to the front in the other lane and force their way in. Some drivers are very tired of people not wanting to get into line and will refuse to let them in. This guy may have thought that was what you were up to.

    OH!! I have to comment on this. We think the same exact way..I was driving down the interstate with the cruise on, when I came upon a pickup, I went around him and then got back in the outside lane. Then he sped up and came around me, then got in front of me, then evetually slowed down, when all of this time I have my cruise on, I haven't changed speeds. So when he slowed down I ended up having to pass him again.!!! I got passed him then he sped up again!, and passed me, this time he went like a bat out of hell and pulled away from me. Also getting on someones bumper only makes it more slow in the long run due to harsh breaking.     America is the most individualistic nation in the world. Because of this American's are the most individualistic people in the world. ';Almost every'; American sees his or her world through his or her eyes only and does not take into consideration the existence of others and their feelings, needs, etc. So, let's just say this...the guy that sped up to not let you in his space did so to not let you in his world per say. Americans like walking around in a self-contained bubble...nothing gets in nothing gets out. Then they are comfortable. This is a harsh interpretation of American individualism (I am an American myself and have just passed sixth year psychology with an A).

    After many years of commuting in SF Bay Area traffic I have seen it all. Most guys are interested in only one thing...getting there first. Seems like the whole reason for their existence is to beat you, to win. It may be left over from childhood when boys are taught to compete at the physical level. Since they are in their very own personal space which they feel they have all the control...competition drives them (no pun intended) to win. Road rage is a very serious problem and I think your method in making room is the right way. Dont ever do it back to them..just let them go. More than one person has been shot just this short year on our freeways just because someone cut them off...Cut them off...wow! Just making a simple lane change these days is cutting someone off...Be careful and be kind.
    Psychologically, these morons are allowing themselves to react to emotions the same way as if someone cut in front of them at a grocery store line. Also they have large but fragile egos due to very low esteem. They think by not letting you in, it gives them false sense of superiority and control over other people. In essence they are angry due to something that happened to them during their formidable years and it's a mask for deep rooted fear. Next time this happens, feel sorry for him/her. Normal humans are kind, helpful and has compassion for fellow humans.
    I've always wondered about this as well. It's especially bad in Cali where everyone is always in a rush and always want to be first(resulting in road rage)---which is one of reasons I don't like to live there.

    Long story short, I was trying to change lanes because the lane i was in would turn into an exit only lane soon. I checked my rear view mirror and saw 2 cops on motorcycles. I immediately checked my speed and was going 62 in a 60 mph. One was in the lane next to me, the other I couldn't tell if he was in the next lane over or in the same lane but I think he was in the next lane over. I couldn't tell how fast they were going because they were on motorcycles so I put on my turn signal to see if they would slow down/maintain speed and let me get over or speed up. They maintained speed but by this time, the other cop had speeded up but since he was on a motorcycle i couldn't tell if he was in the lane next to me or the next lane over. I still had my signal on, i looked at the cop, he gave me a wtf what are you waiting for face so i slowly moved over and evidently i made a bad judgement call cause he was indeed in the lane next to me and pulled me over. I know i made a very stupid mistake and should have just stayed in the lane and took the forced exit so i don't need to hear what a dumb move i made. But he also put on the ticket that i was going 75 mph in a 60. My max speed was no more than 65 during the whole ordeal.     You admit you were speeding, even though it was 2 miles over the limit, so you really have no defense for that. The fact that they put down 75 will not make a difference in the fine in most jurisdictions, since they usually start with 1-15 MPH over the limit.



    Your lane change story might enable that part to be dropped, if you're polite and dress nice.
    You may have a case to have it reduced, it couldn't hurt to try. I know what you mean about not knowing which lane the motorcycle was in. I feel the same way, it's hard to tell.
    You need to prove to the judge that the officer had no way of calculating your speed in that short time and you made sure not to go anywhere above 65. In general you should try to keep extending your court date as much as possible and get an arraignment. Cops have a very busy schedule, and if he does not show up to court, your case may be dismissed. Also do more research on this, it is easier than paying money.

    Fighting a traffic ticket?

    I was given a ticket for ';change lanes not in safety';. The road conditions were poor as two other vehicles lost control on the same stretch of hwy. I had a transport truck in the right lane, myself and the car in front of me in the left lane. I could not see the shoulder due to the transport truck.

    The truck then changed to my lane and the car in front of me, changed to the right lane and sped past the truck. My car being low to the ground and the road being wet, my windshield was being caked by back splash from the truck. I changed to the right lane and at that point noticed an officer with a tow truck and the arrow pointing to move to the left.

    I tried to get back in behind the truck, but my tire hit a slick spot and my car went sideways. I managed to pull the car off the road with no collision involved.

    Officer yelled at me that I had more than enough time to change lanes and gave me a ticket for ';change lanes not in safety';. $110



    This is my first ticket in 12 years and I have been told that I will gain two demerit points due to it. I contacted POINTTs and they suggested going to trial. I have never done this before and don't know what is involved in with going to court.

    I don't care what anybody else tells you, however, it would never hurt you to explain to the judge the circumstances that existed.



    The officer may have been concerned that you came close to hitting him...this upsets all officers and anybody else on the side of the road!



    As another already stated...get photographs of the area to show the court what you saw.



    Judges understand unusual circumstances along with people taking the time to show up in court versus just sending in the fine!



    Judges can also most often than not see through the excuses some people use.

    You won't win with that story. I read ';I could not see so I changed lanes';. That would be an unsafe lane change by definition.
    I went to traffic court in California and won. However, several people before me lost. I had photos of the area I got the ticket and and a witness who was in the car with me. The problem is that the law says you need to drive according to ';conditions'; and the weather conditions at the time were bad so the officer can say you should have been traveling slower. Trial is a different issue from traffic court. If you are seriously considering a trial please check with a lawyer specializing in traffic violations. It won't be cheap but they are worth the money if you need to get this ticket off of your record.
    It's not worth it to go fight it for the amount and the points assessed. If you were low on points or the fine was higher, you would have a reasonably good chance of getting the fine reduced and the points set aside, but your time and energy are better spent doing something else.



    If it really really bothers you and you have the free time to go to court, you are correct in thinking the risk would be additional court costs, but your story sounds reasonable enough to me if there was snow on the road, but not if it was just rain. If it was snow, I can see the commissioner or judge reducing the fine and points. But with rain, I doubt it, so its just not worth the hassle.



    This is a situation where you are benefiting from a good driving record. You can afford to take the points and just chalk it up to a stressed out cop in a bad mood.

    THey run red lights, they do rolling stops. I even had a cop pull my dad over, because my dad changed lanes in front of him, and the cop didnt like it becuase the cop was going faster than what he should have been going, so he pulled my dad over..     I think some cops do abuse their priveleges. However, there are some people that just don't like them for doing their jobs. There is a way for cops to do their jobs without being jerks, and I agree they should set a better example.
    I really don't have a problem with the instances you site. In the case of your dad, he failed to check on-coming traffic before he merged into the fast lane. Some cops abuse their power, they're eventually weeded out. Most cops do their job to the best of their ability, and I for one am thankful for them.
    I almost had a cop hit me head on the other day. I was on my way to work and he was coming toward me running the yellow center line. I was behind a van so I didn't see him untill I saw the van swerve really fast. I wish he would have hit me, that would have been a nice law suite.     The other day, I noticed in a state park how the conservation officers idled their cars at leisure, while they just yapped outside with each other. I sent a note to the Commissioner of the state's Department of Environmental Protection, respectfully looking to understand the exception against the Clean Air Act. Why can they idle their cars for hours, and I can't? I visited the park two weeks later again, and all officers had their cruisers shut down.





    Cops do whatever the heck they want in traffic situations. In this day and age, you will benefit from snapping the moment in your cell phone's camera and *then* bringing it up to the pertinent authorities.     And all this time I thought it was only me, the way I think. It is happening, all over too. I lived in Maine for 5 years, it happened there. Now, I'm in CT and still, it's happening here. I was behind a cop the other day, coming down my street. He's a few feet from the stop sign, no brake lights, just sitting there. I don't know what to do, so I wait for him to make a move.     First off, the police need not justify there actions to you. In most states they are exempt from the vehicle and traffic laws. That means they can do whatever they want in the performance of their jobs. Law makers and other gov't officials, who know much more about the law enforcement job, realize that and pass laws that allow cops to do what they need to do. There are plenty of things a cop can do that you cant. Can you carry a gun 24/7? Mace? Taser? Automatic Rifle? Do you have lights and sirens in your car? How about plates?     MAny times cops are running from call to call. They do not always use lights and sirens. Sometimes its is faster to just drive without them. When you turn on the lights and siren people do stupid things that can actually delay you and make it more dangerous.


    Bottom line, you have zero right to question how a cop does his job. Often times you have no clue where he is going or what he is doing. You sound like you know very little about that job to begin with and have learned bad behaviors from your father which will harm you in life.     You know whether the cop was waiting to get more info on a call? Maybe the call was just coming over, something like a child not breathing, and he was in the area, but had not been given the full address yet? Ever think of that or just yourself?

    I know there are what appear to be many traffic violation committed by law enforcement while they are driving, but you have to keep in mind that we as drivers sharing the roads with them don't know if they are heading to an incident or just trying to get to a late lunch engagement.





    Most of the law enforcement people I know are very conscientious and defensive in their driving habits. I also know that most, if not all, of them take far more classes in how to handle a vehicle than 99% of the drivers on the road do.





    Of course the above is not intended to justify the fact that yes, there are some out there there who do misuse their power of authority to satisfy their mental defencies.
    The court system is all about money fines fees etc. The police are just the tax collectors.. my friends purse was stolen from the ymca locker room .. the employees had a women on tape leaving with a large backpack and they suspected her in many other purse snatchings ,,, they had a full profile for her in the computer and the police officer came and just made up excuses not to even contact he,, The credit card companies solve these type of crimes type of excuses,, I went to the police station and talked to a supervisor.. he said.. we get so many of these we cant go out and make contact with the people no one saw her put the purse in her bag .anyhow......These cops are out on 25 mph roads looking for seatbelt violators thats why they are to busy...100 bucks a pop in their pocket or solve crime they chose the 100 bucks... Cops are lame the system is the cause I know but Why dont cops speak up and do there job......The first cop said if he talked to the women identified by ymca staff as a suspect in many purse snatchings she would tell him to go blow sand...huh? at least she would know they were on to her.. they had our car keys our house keys our drivers licenses .The thief could have gone straight to our house and cleaned us out.... and I asked about that danger and the cops didnt care,,, .we had to get new car keys new house keys and the cop s were yawning,, the ymca suspended the womens membership after that ...she had a young man as a look out they worked as a team they caught the man bringing boltcutters int the ymca in a gym bag.. a few days late our credit cards and my friends drivers license wer dumped near our house that was scary.. they were casing our house...     You know cops are just human like the rest of us. Some of them follow the rules, some but themselves above. They make mistakes. If you are doing what you are supposed to do, I guarantee you won't get pulled over. The people that are usually upset with police conduct, are the ones breaking the law (in one way or another) Not all of them are bad...that is a huge generalization. Sorry, I realize this probably isn't what you wanted to hear...
    I do, and I have a theory for why they suck at their jobs. It is this: they are paid with tax money. Compare the service that you get from businesses that must earn your money with the ';service'; that police offer.





    If a business fails to meet your expectations, you simply stop giving them money. The feedback is instantaneous. If they fail too much, they run out of money and go out of business. Only those companies that succeed in satisfying your expectations stay in business.





    Now, what is your recourse when a police officer does his job poorly or is even abusive? You have to go through bureaucracy. You might take him to court, but good luck getting a judge that isn't sympathetic to ';one of his own';. You might attempt to address the problem politically via votes. But the voting process is highly susceptible to corruption. Even when not corrupt, it is still quite expensive. Lastly, you could result to violent opposition. Virtually anyone who stands up to police in this manner loses.





    This is not to overlook the good intentions and heroic actions of some police officers. Police are human beings. Some of them are exceptional people. Sadly, many of them are little more than bullies. The mechanisms for getting rid of the bad apples really don't exist.





    There ought to be more market solutions for offering security and crime prevention. Unfortunately, the majority of people believe that security can only be offered by a government police force that seemingly exists often only to harrass peaceful people and keep them in line.

    First off, the mere fact that a cop speeds doesn't mean he is breaking the law. I can get into any authorized emergency vehicle and drive any speed I feel necessary and there is no violation of the law. Because each state has laws pertaining to the operation of emergency vehicles. Some states have stricter laws, others the officer only has to be in an on-duty capacity. So maybe read you state's laws before you spout out your neck.





    Second, there are jurisdictions that have civilian review boards that handle complaints against police.





    Third, by your attitude alone, I can say that you suck. You have a piss poor attitude. You whine and complain about the police while they are trying to do their job, yet you have haven't done a damn thing for your community (except whine and complain). Even though you indeed suck, I have to thank you. If it wasn't for people like you, and your father, we wouldn't have a job. So please, keep up the good work.

They know that all they need to do is flash a badge and use it as a get out of jail free card. Sad think is most experienced drivers could out perform a cop any day. I know I have.
    People that don't like officers usually dont like them until they need them. Then they are all about getting an officer to their house ASAP and then scream when they aren't there fast enough because all of the officers on duty are tied up on physical domestics, shots fired, csc's etc. My advise to you would be to appreciate that every single one of the officers out there are there doing a job that you don't have enough guts to do yourself. They put themselves in harms way each and every day that they put on their uniform. You should apprciate them, not put them down. If you had a serious priority call at your house and found out that a conservation officer was right around the corner and didn't respond, you would be one of the first ones to file a formal complaint.

    Who's turn is it?

    So if on the Freeway a car wants to change lanes to the right but a car is in that lane but 15 meters aft. The driver in car #1 signals to change lanes to the right but is also waiting for the motorist behind him to pass. BUT The motorist who was going to pass sees the turn signal and he slows down to let the car in. Yet car #1 is still waiting for the car to pass and right now they are both traveling at a constant speed. After about 10 seconds of this nonesense drive #1 finaly speeds up and changes lanes in front of the car even though he wanted to let it pass him first and get behind it because initially car #2 was going faster to begin with.



    The driver of car #1 was me. Doesn't it suck how poor communication is on the road? Istead of motorist talking on their cell phones. Why not talk on 2 way radios so everyone on the road can talk to each other?



    Don't you think we got it all wrong in how best to utilize technology? Both car and electronic communications devices.Who's turn is it?
    The driver in the trailing car should and must maintain a constant speed. His error in judgment was slowing down, ostensibly to be courteous, but instead created a traffic hazard. The other driver (you) in the left hand lane should not have to second guess what the other driver is going to do. To call it nonsense is being charitable.



    That said, going faster than another driver on a multiple-lane road - and not changing lanes - does not constitute passing. The previous respondent is right about passing on the right, but that's not what you've described here. It's not passing unless you are already in the left hand lane, move over to the right and then go back over to the left lane. But even that is not illegal passing on the right when you're on a multiple-lane road.Who's turn is it?
    If you are going to be upset by little things like that you better hand in your license. You want a babysitter.
    Actually, what eventually occurred is correct within the law. You wanted to be nice and let them pass you, however driver #2 being observant, saw your turn signal and proceeded to slow down enough to let you into their lane safely.



    In many states (I can't emphatically say all because I truly don't know that) it is illegal to pass on the right.
    Good grief, most people would be grateful that driver #2 was polite and considerate enough to wait for you to make your move, not to mention safety conscious. If I were driver #2, I would have done the same thing because I'm not a mind reader, I can only predict your move by your indicators. Once you indicated your intention to change lanes, driver #2 rightly slowed a little and gave you room to make your lane change. Be grateful. It could have been some idiot who waited until you started to make your move and then crowded you or tail-ended you.

    Would you cut off another car in road rage?

    Well, I wouldn't really call it road rage in my case. I just wanted to put a good attention grabber in the question because I'm not sure how to ask this. Let me explain. Say suppose you are driving in the right lane on an interstate. There's another car in the left lane slowly approaching your side or attempting to pass you mile upon mile or it's just sitting there going exactly my speed and holding up cars behind them. And say suppose you are gaining up on slower traffic ahead, would you move in the left lane in front of the car that had plenty of time to speed up and pass you? To me, it doesn't matter if they are 2 car lengths back or 2 feet back, I would move in front of them. In my opinion, nobody should be coming up behind me in the left lane if there are no traffic behind me. They should come up behind me in the right lane and then move to the left lane to pass me when they gained up on me. That's the law in most states to keep right except to pass. If there is no traffic behind me and a car comes up behind me in the left lane, then they probably drive in the left lane all the time and that causes a line of 10-20 cars behind them sometimes.



    As long I can see their entire vehicle or their front bumper or their headlights in my driver's side mirror, I would normally change lanes in front of them if I have enough space to do so. If I don't see their entire vehicle and just see part of their vehicle, then that means their front bumper is to the side of my rear bumper and I had times when I wanted to change lanes, but didn't because there wasn't enough space. But as long I have enough space even if it's just 2 feet, I have change lanes in front of them if they are going my speed. I mean I wouldn't move in front of someone going 100 mph.

    No, because that would only make the situation even more dangerous. I agree with you when you say, ';What were they doing in the left lane to begin with if they weren't passing anyone behind me';. That's a good question. People seem to have this idea that as long as they are going a certain speed, or speeding by a certain amount, that it gives them the right to remain in the left lane for as long as they want, even when they aren't passing anyone (';left lane hogs';). Obviously, this is not the case. The law says keep right except to pass, so they have no reason to be in the left lane unless they are actively engaged in passing another vehicle, regardless of how fast they are going. As long as they are moving past the vehicle to their right, and move back over once they complete the pass, they are obeying the rules. But if they get up beside you like you describe, and remain there for miles without passing you, I would just back off a bit and slow down to let them get ahead of you. Once they do, and they are out of your way, you can speed up and pass them, and never have to see them again. That is what I would do. I wouldn't cut them off, tailgate them, etc, because cutting people off and tailgating cause just as much road rage as left lane hogs do. Just try to do what you can to let them pass you, then once they do, take the first safe opportunity to pass them so you will never have to see them again.     NO I wouldn't cut someone off. I would have SPEED UP SOONER and got room to get in front of them.
    Sometimes I wish I were driving an old junk and did not care if I smashed it up. When some ****** cuts me off or tailgates me, I would plow right into them untill the car they were driving was reduced to a piece of junk. I do get pissed off sometimes, but I hold my temper and do nothing. Do you think if I did that, the other person would stop doing those stupid things? I kind of doubt it.     Each Saturday I drive 55 miles, one way, mostly on I 83 in Pa. I know exactly what you are talking about. As a retired police officer I maintain enough distance between me and the car in front to stop safely in an emergency. Cruising along at or below the speed limit in the right lane I observe what you describe. The car approaching in the left lane slows to my speed and remains off my left rear leaving no room for me to pull out and pass the car in front, safely, if it slows down.. Some drivers are followers. I slow down opening up 7 to 8 more car lengths from the car in front. If the left lane driver stays with me I accelerate sharply gain a two car length advantage on him, pull out, pass the car in front of me and return to the right lane- this usually gets things moving along. This happens a lot since I'm driving a 1973 Nova but I have equipped it with 380hsp to accomplish this safely. You are correct that vehicles should be in the right lane and after passing should return to it. You will have to be extra observant and plan ahead to avoid this circumstance. Remember, they are on their cell phones, talking to their passengers, daydreaming or even eating food. They are just plain dangerous. Your best attitude and defense is defensive driving. Inconsideration for others, poor driving, selfish attitudes and ignorance cause most accidents. Get there safely using all your driving skills. Once you lose your temper anything bad can and will happen behind the wheel.
    I don't 'play games' in traffic. The problem with road rage is that there are no rules and people die as a result. I do not intend to be one of them.

    Whenever I am 'invited' by another driver to partake I just get the Hell out of their way. That just drives them nuts when no one else obliges them.

    No, I wouldn't, and I understand how you feel. Happens to me.



    I hate it when some idiot in the left lane sits with me door-to-door. They've taken away my cushion space that I created, and I don't know what they'll do next. Swerve into my lane? Side-swipe me?



    I'll ease up on the gas and go slower. Usually they'll either speed up, or get in front, when they could have gotten behind me, especially if there's no traffic.



    If they get in front, I'll change lanes when safe to do so, and pass them with at least 2-3 car lengths, depending on traffic. I don't want to be around anyone like that. Gimme back my cushion space!
    Well no that is sort of like playing a mini ';Chicken with the Train'; i would never do anything that could hurt a person, say you are driving then you get over and cut another car off by purpose and they speed up to try to scare you so you can get back over, and they hit you because you jumped in front of them, when that all could have been avoided!



    But if i was sure i had enough room to get over then yes, but not just to try and let them know you are mad my cutting them of, which could put someones health in Jeopardy in certain instances!
