Who would be at fault in this accident involving a car with road rage and a SUV attemping to make a U turn?

This is hypothetical. Say suppose a car is the first car stopped at a red light in the left lane. The light turns green. The car is about to go, but a SUV from the intersection pulls in front of the car in the left lane and stops. There's a minivan in the right lane, so the car can't change lanes. So, out of road rage, the car uses the center turn lane to pass illegally and the SUV attempts to make a U turn and they collide.



When the police arrive and ask questions, the driver of the car was going to say he had to swerve to avoid the SUV that cut him off, but the cop asked was he turning left at the gas station on the corner and the driver of the car said, ';yeah, that's it, I got into the turn lane to make a turn.'; If there was a place to turn and that's possible, then the SUV would be at fault for unsafe lane change or illegal/unsafe U turn? I know it may not seem fair for a driver to get away with road rage, but if there was a place to turn then how would they be able to prove that the car didn't get into the turn lane to turn instead of passing illegally.



When insurance investigates accidents, do they ask detailed questions about why they were turning there, where they were going? Such as in this example, if the driver said he was intending to turn in the gas station and they asked what for and he said to get gas, would they be smart enough to check the gas gage in the car to see if he needed gas? And if he has a full tank, then his story wouldn't add up. Of course he could say he was going there to get a soda or something else.



Also, if he told the police a different story such as he swerved to avoid the SUV and later told the insurance that he got in the turn lane to turn, 2 different things, would insurance not believe anything he says because his stories aren't consistent?



I'll love to see answers from those who work in insurance and who would be at fault if the driver of the car got his story straight and was convincing that he was intending to turn and who would be at fault if his story didn't add up or would his story matter?Who would be at fault in this accident involving a car with road rage and a SUV attemping to make a U turn?
Dude, I have read your question three times. I am completely lost on that first paragraph. Many areas, Uturns are illegal. Most of the time, if there's an accident involving someone making a U turn, the guy with the U turn is at fault. If (trying to read this), both these cars are pointed in the same direction, and the left most car turns left, and the car to the right makes a U turn, the u turn car is at fault.



Insurance will compare the statement to them, with the statement on a police report. However, keep in mind, these days in most urban areas, if both cars are drivable, and no one is injured, most of the time the police won't even come to the scene.



Insurance is going to try to recreate what happened, both from the physical damage, and the two (or more) descriptions of the accidents.Who would be at fault in this accident involving a car with road rage and a SUV attemping to make a U turn?
