Help to fight wrongful Speeding ticket?

I got a ticket on I580. The officer claims that I was speeding at 88 MPH in 65 zone (violation 22349). I am 100% certain I was not going faster than 72 for the following reasons:-

1- My car is brand new (I don't have the license plates yet) . I am trying to break it in and I do not rev the car higher than 3000RPM (car is stick shift). At 3000RPM in 5th gear the speed is 72 MPH

2- The area is known for speed traps. I check my speed consistently



I believe here is what happened. Right before I got pulled over, another car (same color, and similar shape) was tail gating me in the most left lane. I changed lanes lane to let him go, and switched back to the left lane. The cop pulled me over in 2 minutes. My believe is that other car was the one they saw.



The cop also indicated that he followed me and I was speeding at 83. This is also not possible since:

1- I saw the cop switch lane behind me about 200 feet back (this happened during rush hour, and the lane next to mine was full).



2- Seeing his lights, and not thinking it was for me, I immediately changed lanes to let him go and also checked my speed limit (about 69MPH)



3- He followed me so I continued to change lanes until I was on the shoulder at neither of these time, I was going any faster than 65MPH.



Details of the ticket:

The tickets says approximate speed 88; but it does not indicate how is was determined. It does not have the Radar/Lidar Unit/Patrol Vehicle No. either. I am not sure if these help, but thought to write it.



My last ticket was over 4 years ago for going 10 miles over the limit.



I am planing on going to court for this. How can I fight/prove this?Help to fight wrongful Speeding ticket?
Print this list out and give it to the judge, and explain it all to him. There are some judges that have common sense. You may be blessed with a good one. He will look at your record, and may even dismiss it. I got ticketed for speeding once when I knew for a fact that I wasn't, primarily because I had just turned on to the street and there is no way possible that a 1985 4 cylinder car could go 60 mph in 200 feet. Just take it to court and explain it to the judge. Nine times out of 10, it will get dismissed if he sees you as an educated, honest person. :-)Help to fight wrongful Speeding ticket?
Either way, at several points you WERE speeding anyway. It's rare that people win in these kind of cases, unfortunate but true.
You can't you call tell the judge and he may go easy on you but the new radar MachIenes prints out a paper and is attached to the officers copy and sent to court, keeps the police out on the street not in the court room. The officer might have made a mistake but who do you think there going to believe? bite the bullet tell him you did not think you were going that fast and think he may have made a mistake but am not sure and he will go easy on you, at that speed 88 your about 15 miles an hour over the limit which is reckless driving and he could of arrested you, he may wrote on the ticket est speed and did a guess but he will win, Don't go to court and take one of our officers off the street to fight a ticket since it is only one go to traffic school and it will stay off your record. I have been guilty too with a new car doing 80 miles an hour and think I was doing 70 it's easy to do with the ultra good suspension and quietness of the cars of today. Good luck and watch your speed I bought my 2008 with cruise on it so I can set it and be safe cause it's real easy to creep up to 80 or 90 when the rest of traffic is doing it.
Your best bet is to contact the courts and ask them these questions. They are the ones who will process your ticket and will know all the laws and regulation. You should also ask the courts if you are allowed to take a driving school class. This will prevent your insurance from going up and points from being placed on your license. Just make sure you get the courts permission before doing so. If you don檛 the courts will reject your driving school certificate. Good luck!
