What should I do in this case... car accident?

I was in a car accident last week, what happened is that I was driving down the road, when I saw there was an intoxicated man walking down the street.



The street is pretty narrow and there was a car right next to me so I couldn't change lanes.

I tried to avoid the stumbling pedestrian because I really did not want to hit him and I was afraid he was going to stumble into the middle of my lane. Being worried I would hit him, I didn't pay attention to the light that turned red.



I ran the red light and a school bus hit me.

I wasn't hurt, the 5-7 kids on there weren't hurt, but the driver claimed he was hurt, not sure how, his car weighs 15 tons while mine weighs 1.5 tons. Anyway, my car was totaled, very little damage done to bus, under the suspension I guess.

I talked to the head of the school board who handles this and he said the bus driver was back at work the following day and only had sore ribs.



I got a ticket for $75 for ';disobeying traffic control device'; or ';going through a red light'; and I have to appear in court because, according to the cop, ';somebody got hurt.';



The cops handled the situation pretty badly, they didn't go after the intoxicated pedestrian, they really didn't pay attention to what I was saying, and I witnessed them laughing several times during their ';investigation.';



People are telling me I should fight this, I have a few witnesses who saw the drunken man walking down the street, but to my knowledge, I don't know of any witnesses to the actual crash.

Should I fight the ticket? Or should I plead guilty and go to court supervision to have it removed off my record? Is it that much worse because I hit a school bus? Can anybody give me some legal advice, besides, talk to a lawyer?

It's pretty cut and dry. You ran a red light, and you were hit by another vehicle as a result. It was 100% your fault. The cop was right to give you a ticket, and fighting it would be a waste of time.



If you couldn't safely get around the drunk, you should have put on your turn signal and stopped until you could safely change lanes. Drunk or not, he was on foot, and you were driving. Whenever you are behind the wheel, you are responsible for having that vehicle under control. If the police had chosen to catch the drunk, they might have charged him with public intoxication. The wreck that had just happened was a much higher priority.What should I do in this case... car accident?
If I was your lawyer, I would tell you to plead guilty. You chose to drive by this drunk and you were the one who was distracted and you ran the red light. The drunk was stupid, but he did not make you do anything.
Man you were unlucky when that happened. What are the odds of that? I would just plead guilty.
