When two cars are traveling at approximately the same speed?

in the flow of traffic change lanes at the same time. How do you determine who is to blame? I had this happen to me last night on a busy road when a car sideswiped me while we were both changing lanes. He was driving a black car (it was dust) and he did not have his headlights on. I put on my traffic signal before I changed, but did not see him due to the lighting and the color of his vehicle. We hit and did approximately the same damage to both of our vehicles. (My damage was a little worse) The police did not issue a ticket to either of us, but I do not know what to tell my insurance company. Are we both at equal blame? When two cars are traveling at approximately the same speed?
if he was in your blind spot he should have been able to see you with your blinker on changing lanes therefore he should have gotten a ticket. just tell that to the insurance co. don't admit blame to the insurance co.When two cars are traveling at approximately the same speed?
Wow, that sucks. Hopefully an insurance agent with experience in such cases will respond with some insight. Sounds like one of those random things were fault might be 50/50.
The car that did not have his light on at that time should have gotten an ticket. you should have till got an statement from the police.
