How do I defeat an unjust ticket for changing lanes without signaling?

I'm in Tennessee.

I was given a ticket by a cop who clearly wanted only to write a ticket. A van pulled in front of me and for a mile he was speeding up, slowing down, slamming the brakes, and swerving OFF THE ROAD then jerking back on. I didn't feel safe behind this driver so I waited until it was safe to do so and was in the passing zone and went around him. It was heading into a small speed trap town, and I never went over the speed limit of 35. An unmarked car ( it was dark, I didn't know it was a cop ) rammed behind me - rammed, as in, his push bumper touched my bumper. When I didn't speed up he put his lights on. I pulled over. He asked for my license and reg. so I gave him my license and I said the registration is in the glove box and when I went to reach for it he said, ';that's OK, don't worry about it,'; and went back to his tyranny mobile. He came back and said I was speeding, I told him I wasn't speeding; he told me I was weaving, I told him I wasn't weaving I was passing a possibly drunk driver. He told me I didn't have my turn signal on. I said I don't remember. He wrote down that I passed without signaling and I said, ';....for not using a turn signal?'; He gave me attitude and threatened to write me up for another 100 for not having my registration. I told him I had it but it was in the glove box. He said whatever, you can contest it in court Febuary 15th, then threatened me he'd write me up if I gave him any, ';lip.'; I said whatever. This little piggy walked all the way back to his car.

The ticket is for 95 dollars and he lied to me about the court date - I checked the print and it said March 15th. Maybe he made a mistake, but he was clearly just trying to write me for something. He couldn't drum up a speeding or reckless charge and purposefully didn't take my registration so he could try to threaten me with it. I ain't standing for this.

I just want to know do I have a chance to win? Has anybody beat a b.s. charge before? What defense did you use? Can I sue? I don't want to win, I just want to cause trouble for them for their mafioso type highway robbery tactics.

Chalk this up as a leaning experience. The date on the ticket is what you should rely on, not what the PO says. I don’t know if this falls into the same category, but remember that the police can legally lie to you to get you to admit guilt, which I think is a good thing for many crimes.



If you have a clear driving record, take it to court. If you get a fair judge who believes your story, you might have a chance. But the part about him touching your bumper sounds a little fishy. Even if it’s true they won’t believe you. And don’t cite “GG Allin: F*** the law”; that’s a sure way to get lose your case. Civility goes a long way.



And no, you can’t sue the officer or police department for this.
