If somone changes lanes directly in front of you and instantly slams on the brakes.?

Is it still your fault? You don't even have time to reset your distance to them and wham. They're on the brake and you hit them? How can it be your fault if they made the lane change and the stopped abruptly?If somone changes lanes directly in front of you and instantly slams on the brakes.?
That scenario, and someone backing up into you are the exceptions to the ';It's your fault'; rule.If somone changes lanes directly in front of you and instantly slams on the brakes.?
Depends on the cop. They could charge you with following regardless of the fact that you were cut off. It sucks, but it happens. The other driver should also be ticketed for something too though, I would think.
Sounds like the ';swoop';, an insurance scam, people do this on purpose to collect on insurance, have the Police ck background on them, express your concerns, otherwise it is your fault.

the car in back is the one who is at fault
givin this situation it would be your fault ,you would be ticketed for following to close and failing to reduce speed to avoid an accident.



figure the car ahead of you will reduce spped to get in the next lane(being it 1 mph or not) your still traveling the same speed and going faster than the other vehicle.(basic physhics)



so you will be closer to the other car in quicker time



next time i wreck amend(so for the pun) slowing down when someone changes lanes infront of you
Happens all the time here in los angeles, I read where there are teams of people who stage or cause accidents to happen. They stuff some old car tires into the trunk of the car (it cushions the impact) and they pay someone to ride in the back seat. The passagers all make phony claims with some doctor or chiropractor.



I'd carry a camera with me and the next time this happens take pictures of everyone involved.
They would be cited for an unsafe lane change resulting in a crash.
You have to remember that no one else will ever experience what you experienced in the driver's seat, so what you have to attempt to do is articulate what happened as best as you can possibly can. This is normally done thru statements relating to speed, time, distance. You can't just say the guy made a lane change and then stopped, you have to be specific. The guy 's rear bumper was 2 inches from my front bumper when he made a lane change. He traveled 5 ft then slammed on his brakes. When he slammed on his brakes I was 5 ft behind them. 2 seconds passed from the time he made the lane change until he slammed on the brakes. Understand? It can be your fault if the sequence of events is inconsistent with an abupt, instanteous stop. Although this is a scam pulled daily, the rear car pays....primarily because short of a video tape of the vent, their is no way to prove fraud was committed.
